From a palm beach florida probate lawyer
Can I purposely leave one of my children out of my Will?
Absolutely. Years ago, people would leave $1.00 to a particular child, but that created problems since a child who only received $1.00 was usually not too happy about it and would not sign a receipt confirming they actually received it. This would hold up the estate’s closure and cost money to resolve. Instead, you can simply mention that no provision is being made for that child. If, however, you do not at least mention the child by name, the child may have a claim against the estate based upon an assumption that you “forgot” the child.
